                Sh.Shahnoor Alam, Regional Service Manager of opposite party No.1

          File taken up in the National Lok Adalat.  On 7.11.2016, Sh.Shahnoor Alam, Regional Service Manager of the opposite party No.1 suffered statement that opposite party No.1 is ready to replace the mobile handset in dispute of the complainant with same make and brand with one year extended warranty. In view of the above statement, Sh.Kamal Kishore Sharma, complainant suffered statement that he has receive today in the Forum a new mobile hand set of the same make and brand. But however, he pressed for compensation and litigation expenses. The handset mobile hand set was purchased by the complainant on 22.10.2015. The said mobile hand set was deposited with the opposite party No.3 for repair and till date, the mobile hand set has not been repaired by the opposite parties and same is lying with the opposite parties. Opposite parties have compelled the complainant to file the present complaint. As such, in our considered opinion, the complainant is entitled for compensation and litigation expenses. As such, opposite party No.1 is directed to make payment of compensation for deficiency in service to the complainant to the tune of Rs.3000/- while litigation expenses are assessed at Rs.1000/-. Instant complaint stands allowed accordingly. Copy of the order be furnished to the parties free of costs. File be consigned to the record room.
