DISTRICT FORUM – 1 MISCELLANEOUS APPLICATION NO. 114 OF 2010 IN CONSUMER COMPLAINT NO. 172 OF 2010 S.C. Gabha vs. Zonal Manager, FCI & Others. PRESENT: Sh.Raj Kumar Syal, Adv. for Applicant/OP No.5. Dated the 27th September, 2010 ORDER 1. The OP No.5 has filed the present application for review of order dated 10.8.2010 passed by this Forum on the ground that there is no delay on the part of OP-5 (R.P.F.C. Chandigarh). 2. We have heard the learned counsel for applicant/OP No.5. We are of the opinion that after the disposal of the complaint, this Forum is functus officio and has no power to modify or re-draft the order dated 10.8.2010. 3. The aforesaid view is fortified by an authority of the Hon’ble Madhya Pradesh State Consumer Disputes Redressal Commission, Bhopal reported in I (2010) CPJ 537 titled “New India Assurance Co. Ltd. vs. Geeta Bai”, in which it has been clearly stated as under:- “Forum functus officio, not empowered to entertain same - Only remedy was through appeal” 4. In view of the above, the present application is accordingly dismissed. 5. Copies of this order free of cost be supplied to the parties.
