JUDGEMENT.
The facts of the case is that the complainant has filed this complaint alleging deficiency in service against aforementioned O.Ps for non payment of maturity amount towards Recurring Deposit under Sahara Anokha Scheme,. for which the complainant sought for redressal of the grievances raised by the complainant.
Upon Notice, the O.Ps. appeared thorough their Counsel and filed their written version denying the petition allegations on all its material particulars.
FINDINGS
From the documents filed by the complainant it reveals that the complainant had deposited amount in the above organization. In support of deposit of money in different dates the Complainant has filed copies of deposited pass book vide A/c No.24215600137 dt.30/05/2015 wherein the complainant deposited an amount of Rs.96,000/- in the Opposite Party Branch at Bhawanipatna. When the complainant finally knew about ulterior motive of the Ops to swallow the deposited amount the complainant took shelter of this Commission for redressal . The Ops have violated the fair practice of the trade and hence liable to refund the deposited amount with compensation. Hence, this complaint.

We relied citation which is held and reported in CCC 2005 page No. 192 (SS) the Hon’ble State CDR Commission, Maharashtra where in observed “ Consumer Protection Act,1986- Section 2(1)(O)- service-Co-operative society-service rendered by a Credit Society in accepting deposits from the investors falls within definition of service in Section 2(1)(o) of the C.P.Act,1986.
This Commission found the act of withholding payment by the Opposite Party . is not confide. It is arbitrary and oppressive and is gross deficiency in service on the part of the O.Ps. Hence the complainant deserves to be compensated.
In our view the interest of justice would met if this Commission award accrued interest from the date of maturity till its realization.
In view of the above discussion relating to the above case and referring citations we allowed the above complaint petition in part.
Hence to meet the ends of justice, the following order is passed.
ORDER
In result the complaint petition is allowed in part against the O.Ps. The O.Ps. are ordered to pay the total deposited amount of Rs.96,000/- with interest @ Rs.9% per annum from the date of maturity till realization.
Since we award the interest on the amount due which has not been paid by the O.Ps after the due date, no further compensation is awarded inter alia to pay Rs.2,000/- towards litigation expenses.
The OPs are ordered to make compliance the aforesaid Order within 30 days from the date of receipt of this order .
