Order no.  16, dt. 7.12.2020

D/hr. no. 3 is present on call and files a petition stating that she received the decreetal amount vide cheque no. 007519 dt. 22.10.2020 of IDBI Bank Esplanade/ Kolkata Branch amounting to Rs. 7,43,660/- in favour of Ratna Rani Basak and the D/hr. no. 3 receives the cheque for self and on behalf of her two daughters on full and final satisfaction. D/hr. no. 3 submits that both the daughters are in her custody and living with her. So, she is entitled to collect the said cheque from the opposite party LICI.

 J/dr. is present on call and files agent hazira. Ld. Advocate on behalf of the J/dr. submits that the D/hr. no. 3 receives the cheque on full and final satisfaction as such the execution case being no. 32 of 2018 is deserved to be dropped as J/dr. complied the order dt. 12.4.2018 in connection with C.C. case no. 20 of 2016 in toto.

Heard the ld. Advocate of both sides and perused the case record it appears that this Forum is in the opinion to that the D/hr. no. 3 receives the decreetal amount on full and final satisfaction and she has no further claim against the LICI. The J/dr. also filed the delay cost vide order no. 9 dt. 15.1.2020.

 Hence, ordered that the Execution appeal being no. 32 of 2018 be and the same is dropped on full and final satisfaction.
