ORDER

1.   The applicant/complainant has tendered a copy of the order dated 26.02.2024 passed by the Hon’ble State Consumer Disputes Redressal Commission, U.T. Chandigarh in MA/565/2023 in A/56/2023, which is ordered to be taken on record as Annexure RX.

2.   Heard. Record perused. The present miscellaneous application has been filed on behalf of applicant/complainant for releasing the amount deposited by JD No.4. It has been stated that JD No.4 had deposited Rs.3,71,570/- with the Hon’ble State Consumer Disputes Redressal Commission, U.T. Chandigarh at the time of filing the appeal and the Hon’ble State Consumer Disputes Redressal Commission, U.T. Chandigarh had transferred the said amount alongwith interest to this Commission vide order dated 26.02.2024 passed in miscellaneous application No.565 of 2023. Since the JDs have not complied with the order dated 23.02.2022 passed in CC/113/2021, therefore, the applicant/complainant has prayed for release of amount in his favour. The applicant/complainant has furnished his bank account details as under:

3.   As per office report, an amount of Rs.3,83,830/- has been transferred by the Hon’ble State Consumer Disputes Redressal Commission, U.T. Chandigarh to this Commission.  

4.   In view of the averments made in the application and as the order dated 23.02.2022 passed in CC/113/2021 has not been complied with by JDs and execution application for non compliance of the said order is already pending before this Commission, there is no impediment in releasing the amount. Hence, the miscellaneous application in hand stands allowed. It is ordered that the amount of Rs.3,83,830/-, lying deposited with this Commission, alongwith upto date interest thereon, be transmitted in the aforesaid bank account of the applicant/complainant, against proper receipt & identification. Office to take necessary action for release of the amount. Office should ensure the correctness of the bank account details of the applicant/complainant before getting the amount transferred in his account. The present miscellaneous application stands disposed of accordingly. It be tagged with the execution application file bearing No.EA/57/2023.

5.   Certified copies of this order be sent to the parties free of cost.
