Arguing counsel for the Appellant is not present. Proxy counsel appearing for the Appellant seeks adjournment. Adjournment is strongly opposed. Our attention is drawn to our order dated 08.03.2017 whereby costs of Rs.10,000/- was imposed upon the Appellant for seeking adjournment. It is submitted that the said costs have not been paid till now. Our attention is also drawn to the order dated 15.10.2019 whereby on seeking adjournment on behalf of the Appellant, adjournment was granted by this Commission on payment of further costs of Rs.25,000/- which was payable to the Complainant within four weeks. It is submitted that these costs have also not been paid by the Appellant. -2- It is submitted that on every date, adjournment is being sought on behalf of the Appellant and that the Appellant is not interested in pursuing the Appeal and that no more adjournment be granted and the Appeal be dismissed. We are satisfied that the Appellant is making all efforts to delay the disposal of the Appeal by seeking adjournments and are also not paying the costs upon them for the adjournments. Today again arguing counsel for the Appellant is not available. It seems that the Appellant is not interested in pursuing the Appeal. The Appeal is dismissed for non-prosecution. |
