Petitioner remained ex parte before the District Forum in spite of service.  The District Forum, taking the facts stated in the complaint to be correct, as they were not rebutted, allowed the complaint.  Aggrieved against the order passed by the District Forum, petitioner filed an appeal after an inordinate delay of 554 days.  State Commission has dismissed the application for condonation of delay on the ground that no sufficient cause has been shown to condone the delay of 554 days.

Under the Consumer Protection Act, the consumer fora are required to decide the case within a period of 90 days from the date of filing, in case, no evidence is required to be taken and within 150 days, wherever evidence is required to be taken.

We agree with the view taken by the State Commission that the delay of 554 days could not be condoned without sufficient cause being shown.  Dismissed.
