Heard.
If the petitioner has taken interest free loan from parent of a student who had been admitted then this could not be said to be totally independent and free from the question of admission of the child. It appeared to be a precondition for admission. The amount in question was deposited way back in 1998-1999. In 2003, it was demanded. It was not a donation and if refund of deposit was being sought after the child has left the school then the petitioner should have paid the amount. The District Forum as well as the State Commission were therefore justified in directing the petitioner to refund the amount. The question of high rate of interest would also not arise for interest has not been awarded @ 18% or @ 12% but just @ 6% p.a. and that too from 1.5.2003.
 
 
 

In the aforementioned circumstances, there does nor appear any force in this revision petition and it is dismissed accordingly.
