Opposite party No.2 ex-parte

During the course of proceedings of this case, counsel for the opposite parties No.1 & 3 got recorded his statement dated 11.6.2015 that company is ready to refund an amount of Rs.10000/- to the complainant subject to the condition that complainant shall hand over the accessories i.e.charger, ear phone etc.alongwith hand set in question to the opposite parties No.1 & 3. Complainant stated that this offer is acceptable to him. Resultantly, complainant has handed over the handset in question alongwith battery, charger and ear phone with box to the counsel for the opposite parties No.1 & 3 in the Forum today i.e.15.6.2015. Statement to this effect of the counsel for the opposite parties No.1 & 3 has been recorded separately.

Resultantly, this complaint is disposed of with directions to the opposite parties No.1 & 3 to refund an amount of Rs.10000/- to the complainant within 30 days from today; failing which opposite parties No.1 & 3 shall be liable to pay interest at the rate of 9% p.a.on this amount of Rs.10000/- to the complainant from the date of filing of complaint till payment is made to the complainant. Copies of the order be furnished to the parties free of costs. File is ordered to be consigned to the record room.
