                   Today the case was fixed for filing written version of op no.1 and for summoning of op no.2 but despite repeated calls none appeared to represent the complainant. OP no.2 has also not been summoned for want of correct address to be filed by complainant. Ld. counsel for op no.1 placed on record a photocopy of replacement orders of the mobile in question duly signed by complainant himself saying that mobile in question has already been replaced by the ops and redressed the grievances of the complainant. In these circumstances, we are of the opinion that complainant has not appeared today intentionally because of the fact that his grievances have already been redressed by the ops by changing the alleged defective mobile. As such, complaint is hereby dismissed for want of prosecution being infractuous. File be consigned to the record room after due compliance.
