File taken up today in the National Lok Adalat being held at DCDRC, Complex, Panchkula. Ld. Counsel for the OPs No. 1 and 2 on the instructions of OPs No. 1 and 2, by making a separate statement, stated that OPs No. 1 and 2 are ready to pay an amount of Rs. 9799/- to the Complainant, as full and final settlement of the dispute, subject to the condition that the Complainant shall return the mobile set to the OPs No. 1 and 2 and the OPs No. 1 and 2 shall refund the above stated amount within 30 days from the date of order passed by this Commission.
On the other hand, the Complainant, by making a separate statement, stated that he has gone through the statement made by the Ld. Counsel for the OPs No. 1 and 2 and agrees with the same; hence, he withdraws the present complaint.
Heard. In view of the statement made by both the parties, the present Consumer Complaint is hereby dismissed as withdrawn. It is made clear that both the parties shall be bound by their respective separate statements. In case, the OPs fail to comply with the statement made by the Ld. Counsel on their behalf, in that event, the Complainant shall be entitled to initiate proceedings under section 71/72 of the CP Act, 2019.
A copy of this order be sent to the parties, free of costs and File be consigned to the record room, after due compliance.
