CONSUMER COMPLAINT NO. 317  OF  2023

AWARD

1.   Vide e-mail dated 21.06.2024 received from Sh.Atul Goyal, Counsel for OP No.1, the matter between the parties has been settled and as per settlement, the OP No.1 shall pay an amount of Rs.25,000/- to the complainant within a period of 15 days from the receipt of account details in full and final settlement of the present matter, subject to the return of handset. Vide his separate statement recorded on 21.06.2024, Sh.Gaurav Kant Goel, Counsel for Complainant has admitted the statement of counsel for OP No.1 given in his e-mail dated 21.06.2024 and stated that the bank account details of complainant will be provided on 22.06.2024 and prayed that the complaint be disposed of in terms of aforesaid settlement in Upbhokta Lok Adalat.

2.   In view of the e-mail received from counsel for OP No.1 & statement made by the counsel for complainant and in terms of the settlement, the complaint stands disposed of by passing the following order:-

1. OP No.1 shall pay an amount of Rs.25,000/- to the complainant within a period of 15 days from the date of receipt of bank account details from the complainant and the aforesaid amount shall be transferred by OP No.1 in the bank account of the complainant.
2. In case OP No.1 fails to pay the aforesaid amount within the stipulated period, then OP No.1 shall be liable to pay the same alongwith interest @ 12% p.a. from the date of this order i.e. 22.06.2024 till the payment is made.
3. On receiving the aforesaid settled amount, the complainant shall return the handset in question to OP No.1 forthwith.

3.   The award is accordingly passed.

4.   Certified copies of this order be sent to the parties free of cost. The file be consigned.
