Appellant/Complainant has filed this appeal against order dated 3.7.2017, passed by the District Consumer Disputes Redressal Forum-II, U.T., Chandigarh (in short the Forum only), vide which his complaint was allowed ordering the respondents/OPs to replace his mobile handset with a new mobile handset with fresh warranty, or in the alternative to refund price paid by him when the said mobile handset was purchased. OPs were also directed to pay an amount of Rs.3500/- to the complainant towards compensation for suffering harassment and mental tension and litigation expenses. It is stated by the appellant/complainant that the amount awarded is on the lower side.
2. We have gone through the documents on record. The Forum has rightly ordered replacement of mobile handset purchased by the complainant with a new mobile handset with fresh warranty. The compensation awarded appears to be just and proper. No case is made out to interfere in the order, under challenge.
3. For the reasons recorded above, the appeal, being devoid of merit, must fail, and the same is dismissed, with no order as to costs. The order of the District Forum is upheld.
4. Certified copies of this order, be sent to the parties, free of charge.
5. The file be consigned to Record Room, after completion.
