In terms of order dated 3.8.2021, the respondents had not furnished the requisite information. On the another hand, again the complainant has not appeared before this commission on today and on the last date of hearing i.e. on 27.10.2021, the complainant had also not appeared. Every order passed by this Commission is uploaded on the net website known as ‘confonet’ and no separate notice was required to the complainant or his counsel and the party who initiates into the litigation is supposed to remain vigil towards the proceedings. The complainant or his counsel were having sufficient time to verify the proceedings before this Commission, because after dip in the second wave of covid-19, this commission is doing its working regularly by way of physical hearing to the parties or their counsels. Non appearance of the complainant before this commission shows, the complainant is no more willing to prosecute this present complaint. This complaint is under section 12 of the Consumer Protection Act, 1986 and the same is hereby dismissed on account of default in appearance. However, complainant shall be at liberty to file a fresh complaint, if advised so and in the fresh complaint, he will disclose the particular of this complaint and its fate. File be consigned to the records.
