Alongwith the appeal, an application for condonation of delay of 3 days as per the applicant/appellant (as per the office report 2 days), in filing the appeal, has been filed.
2. Heard.
3. For the reasons stated in the application, which is supported by a duly sworn affidavit and finding sufficient cause, the delay aforesaid is condoned.
4. The application is disposed of accordingly.
5. The Consumer Complaint bearing No.791 of 2014 was partly allowed by District Consumer Disputes Redressal Forum-I, UT, Chandigarh (in short the Forum) vide order dated 10.09.2015 qua Opposite Party No.1 only.
6. In the said complaint, it was the case of the appellant/complainant that to secure permanent residence to Canada substantial amount was handed over to the respondents/Opposite Parties. During pendency of proceedings before the Forum below, an amount of Rs.7,08,000/- was returned towards full and final claim raised by the complainant. To decide compensation etc. matter was kept alive. When disposing of abovesaid complaint on 10.09.2015, the Forum granted an amount of Rs.70,000/- to the appellant/complainant towards compensation for mental agony & harassment and Rs.10,000/- towards litigation expenses. It was further directed that if above payment is not made within one month, the amount will entail interest @12% p.a. from the date of filing of that complaint, till realization of the amount.
7. This appeal has been filed by the complainant seeking interest and also enhancement of compensation.
8. We have heard Counsel for the appellant/complainant.
9. After going through the record of the case, we are of the view that the order passed by the Forum below is perfectly justified. It is not in dispute that during pendency of the proceedings, matter was settled between the parties and entire amount was returned to the appellant. For mental agony and physical harassment, sufficient compensation has been awarded by the Forum. No interference is called for.
10. No further argument was raised.
11. In view of the above, the appeal filed by the complainant is dismissed, with no order as to costs and the impugned order is upheld.
12. Certified copies of this order be also sent to the parties, free of charge.
13. The file be consigned to Record Room, after completion.
