PER JUSTICE JASBIR SINGH (RETD.), PRESIDENT
Appellant/complainant has filed this appeal against order dated 30.07.2018 passed by the District Consumer Disputes Redressal Forum-II, U.T., Chandigarh (in short the Forum only), partly allowing her complaint.
2. It was case of the complainant that she approached the respondents/OPs to process her case for immigration to Australia and she paid an amount of Rs.1,22,880/. It was her grievance that thereafter nothing was done. Visa to the said country was not arranged and as and when contacted, the respondents made an attempt to put her off.
3. Upon notice, reply was filed by the OPs stating that of her own will the complainant has chosen to get their professional service to arrange visa for her. She failed to provide the requisite documents and to pay further necessary fee, on account of which, her case could not be processed further.
4. The Forum, on analysis of pleadings, documents on record, and the arguments addressed, partly allowed the complaint ordering refund of an amount of Rs.1,09,380/- with interest @ 9% p.a. whereof 10.5.2017 till the time of making the payment. Further an amount of Rs.5000/- was awarded towards litigation expenses.
5. The complainant has filed this appeal stating that no compensation has been awarded for physical harassment and mental agony and further the amount awarded as component of litigation expenses is on the lower side.
After hearing Counsel for the appellant and going through the findings of the Forum recorded in paragraphs No.4 to 10 of the impugned order, we are of the view that no further relief can be granted to the appellant/complainant.
6. For the reasons recorded above, the appeal, being devoid of merit, must fail, and the same is dismissed, at the preliminary stage, with no order as to costs. The order of the District Forum is upheld.
7 . Certified copies of this order, be sent to the parties, free of charge.
8. The file be consigned to Record Room, after completion.
