28.3.2022 Present:  Sh. Gagandeep Garg Adv counsel for complainant.
Sh. Jasvir Singh Adv counsel for O.Ps-1 & 2.
Ld. Counsel for opposite parties No. 1 & 2 has suffered the statement that the compromise has been effected between the parties. As per compromise today I handed over the post dated cheque bearing No. 415757 of Rs. 40,000/- dated 17.4.2022 to the counsel of complainant as full and final settlement amount of the present complaint. The complainant can present the above said cheque on 17.4.2022 and I undertake that the same will be encashed. If the cheque will dishonour then complainant is at liberty to initiate the criminal proceedings U/s 138 of NI Act  against the opposite parties. As per the compromise the present complaint may kindly be allowed to the extent of the settlement amount. The complainant can also file the execution application if the cheque will dishonour. On the other hand, Ld. Counsel for opposite parties No. 1 & 2 has suffered the statement that I have heard the above said statement and the same is correct and the present complaint may kindly be allowed as per statement given by Counsel of opposite parties No. 1 & 2.
In view of the statements of Ld. Counsel for the parties, the present complaint is partly allowed. The parties are bound by their statements. However, the complainant is at liberty to file the execution application if the above said cheque will dishonour and also initiate the

criminal proceedings U/s 138 of NI Act against the opposite parties, if desires so. Copy of the order be supplied to the parties free of costs. File be consigned to records after its due compliance.
