Present : Sh.Davinder Kumar, Adv.counsel for the complainant

Sh. Ajay Shanker, Adv.appeared on behalf of the opposite party No.3 and fialed memo of appearance. Sh.S.K.Sharma, Adv.appeared on behalf of the opposite party No.1 and filed memo of appearance. None appeared on behalf of the opposite party No.2 despite due service, as such, opposite party No.2 is proceeded against ex-parte.

Sh.Ajay Shanker, Adv.counsel for the opposite party No.3 suffered statement that opposite party No.3 is ready to refund  the  price value of the mobile hand set in question amounting to Rs.5999/- within 30 days from the date of receipt of copy of order  subject to return of the hand set in dispute,  original bill, job sheet and any other accessories in the possession of the complainant pertaining to the mobile set in dispute in the possession of the complainant to the service centre of the opposite party No.3 within 15 days from today. Sh. Davinder Kumar, Adv.counsel for the complainant suffered separate statement that he accepts the offer made by the opposite party No.3 and case may be disposed of accordingly.

The mobile handset was purchased by the complainant vide invoice  No.wfld20151000185234 dated 7.10.2015 from opposite party No.1 for an amount of Rs.5999/-. Opposite party No.3 offered refund of full price of the mobile handset in dispute to settle the claim of the complainant which is acceptable to the complainant.

. As such, present complaint is allowed with a direction to the opposite party No.3 to  refund  price/value of the mobile hand set in question amounting to Rs.5999/- within 30 days from the date of receipt of copy of order. The complainant is directed to return the hand set in dispute, original bill, job sheet and other accessories, if any, in his possession pertaining to the mobile set in dispute to the service centre of the opposite party No.3 within 15 days from today. The opposite parties are directed to comply with the order within 30 days of the receipt of copy of order, failing which, awarded amount shall carry interest at the rate of 6% p.a.from the date of receipt of copy of passing of order till payment is made to the complainant. Copy of the order be furnished to the parties free of costs. File is ordered to be consigned to the record room.
