1. Sh.Raman Walia, Counsel for OPs has suffered a statement that the parties have settled the matter. As per settlement, two post dated cheques, i.e., cheque of Rs.5,50,000/- bearing No.417602, dated 15.05.2017 and cheque of Rs.5,50,000/- bearing cheque No.417603, dated 10.06.2017, both in favour of complainant (Tarun Kumar) have been handed over to the complainant today. Another amount of Rs.10,000/- towards litigation costs will be paid to the complainant within three weeks from today i.e. 24.04.2017. At this stage, Sh.Tarun Kumar, Complainant in person alongwith Sh.Arun Jangra, Counsel for Complainant suffered statement that they have heard the statement made by Sh.Raman Walia, Counsel for OPs. They have no objection to the above settlement. Complainant has received two post dated cheques, i.e., cheque of Rs.5,50,000/- bearing No.417602, dated 15.05.2017 and cheque of Rs.5,50,000/- bearing cheque No.417603, dated 10.06.2017, both in his favour. As such, complainant withdraws the present complaint subject to clearance of the post dated cheques and making payment of Rs.10000/- as litigation costs to be paid by OPs within three weeks from today. 2. Since the parties have effected a compromise and two cheques of Rs.5,50,000/- each have also been handed over to the complainant and matter stands settled, as such instant complaint is ordered to be dismissed as withdrawn. However, if the amount of Rs.10,000/- is not paid within the stipulated period or the post dated cheques get bounced, instant complaint shall stand automatically revived. 3. Certified copies of this order be sent to the parties free of cost. The file be consigned. |
