ORDER | ||||
Heard. The parties have settled the matter. Statement of Sh.Amit Kumar, Senior Legal Executive of OPs and that of Sh.Sanjeev Aggarwal, Complainant in person have been recorded, in view of which the present consumer complaint is disposed off being settled. Statement of the parties recorded today shall form a part of this order and shall be binding on both the parties. It is made clear that in case the cheques given to the complainant by OPs are not cleared, photocopy of which has been taken on record, and amount is not paid to the complainant by OPs as agreed upon, this order shall be treated as executable decree and the complainant shall be at liberty to get the same executed by filing an execution. Certified copies of this order be sent to the parties free of cost. The file be consigned. |

Statement of Sh.Amit Kumar s/o Sh.Vinod Kumar, aged 35 years, Senior Legal Executive of OPs.
The parties have settled the matter for a total sum of Rs.5,00,000/-. Out of the total amount of Rs.5,00,000/-, two post dated cheques, i.e., one cheque No.113402 dated 15.09.2019 of the denomination of Rs.2,50,000/- and another cheque No.113404 dated 25.09.2019 of the denomination of Rs.2,25,000/- and another one cheque No.113542 dated 23.05.2019 of the denomination of Rs.25,000/-, all drawn on Axis Bank Ltd. in favour of complainant have been handed over to the complainant today. In case, any of the aforesaid cheques on its presentation gets dishonoured, the OPs shall also pay penalty by way of interest @ 12% p.a. on the amount of dishonoured cheque from today i.e. 23.05.2019 till realization of payment. The complainant has agreed to the same. Appropriate order may be passed.

I have read and heard the statement of Sh.Amit Kumar, Senior Legal Executive of OPs above said. The said settlement is acceptable to me. I have received the cheques as stated above. This complaint may be disposed off in the aforesaid terms & conditions agreed upon.
