ORDER
The matter has amicably been settled between the parties. Statement of counsel for complainant and that of senior legal executive of OPs recorded and placed on file alongwith photocopy of post dated cheque of Rs.2,60,000/- handed over to counsel for complainant by OPs today. In view of the statement, the present consumer complaint stands disposed off being settled subject to realization of cheque. Statement of the parties recorded today shall form a part of this order and parties shall be bound by their statement. It is made clear that in case the cheque gets bounced, this order shall be treated as executable decree and the complainant shall be at liberty to get the same executed by filing an execution application.       Certified copies of this order be sent to the parties free of cost. The file be consigned.

Statement of Sh.Pradeep Sharma, Counsel for Complainant.

 

 

The matter has been amicably settled. I have received post dated cheque bearing No.016138 dated 06.12.2018 in the sum of Rs.2,60,000/- in favour of complainant Deepak Kumar Wadhawan from OPs as full and final settlement amount in the present consumer complaint. After accepting the aforesaid amount, nothing remains due against the OPs. The settlement aforesaid is subject to realization of cheque handed over today. In case the aforesaid cheque gets bounced, liberty may be granted to me to get this amount released by way of execution as well as proceedings u/s 138 Negotiable Instrument Act.
