CONSUMER COMPLAINT NO. 26  OF  2019

ORDER

1.        Heard. The matter has amicably been settled between the parties. Sh.Amit Kumar, Senior Legal Executive of OP has handed over to Sh.Avtar Singh, Counsel for Complainant one post dated cheque bearing No.116131 dated 17.12.2019 in the sum of Rs.1,50,000/- in full and final settlement in this consumer complaint. Photocopy of cheque alongwith receipt retained on record. Statement of Sh.Amit Kumar, Senior Legal Executive of OP and that of Sh.Avtar Singh, Counsel for Complainant, to this effect have been recorded separately, in view of which the present consumer complaint is dismissed as withdrawn being settled. Statement of the parties recorded today shall form a part of this order and shall be binding on both the parties.    

2.        Lok Adalat on its own motion makes it clear that in case the aforesaid cheque is bounced, OP shall make the payment of Rs.1,50,000/- to the complainant along with interest @ 9% p.a. from today i.e. 17.10.2019 till the payment is made and this order shall be treated as executable decree and the complainant shall be at liberty to get the same executed by filing execution and for the bounced cheque, OP shall also pay Rs.10,000/- as penalty to the complainant.

3.        Certified copy of this order be sent to the parties free of cost. The file be consigned.
