  1. This is the complaint filed by Gaganpreet Kaur  (hereinafter referred to as the complainant) against Woodlandworldwide.com(hereinafter referred to as the OP/s) under the Consumer Protection Act (hereinafter referred to as the Act)
  2. Briefly the case of the complainant is that she ordered two full sleeve jackets from the website of OP on  23.12.2020 for Rs.5397/-each and received the same on 26.12.2020. The complainant was not satisfied with the products and she wanted to return the same but the return option was not updated on her order and she sent e-mail on 27.12.2020 with the request to update the return option on her order. The complainant also sent e-mail on 28.12.2020 for the pickup of the said orders. It is averred that on 28.12.2020 the OP asked the complainant to send the said products via India post whereas as per the return policy the same was to be arranged by the OP. The complainant sent the products on the provided address via India post and shared the receipt with the OP through  e-mail dated 4.1.2021 which was received by the OP on 7.1.2021 but there was no response from the OP. It is averred that the OP did not return the amount paid for the 2nd order, which amounts to deficiency in service on the part of the OP and caused mental agony and harassment to her. Hence this complaint with the prayer to accept the same by giving direction to the OP to refund Rs.5397/- paid for the 2nd order and also to pay Rs.1,00,000/-as compensation alongwith interest @18% per annum from the date of filing of the present complaint till realization.
  3. Notice of the complaint was duly issued to the OP but it did not come present to contest the complaint and was accordingly proceeded against exparte.
  4. In support of the complaint, the ld. counsel for the complainant has tendered in evidence Ex.CA affidavit of the complainant alongwith documents Exs.C1 to  C10 and closed the evidence.
  5. We have heard the ld. counsel for the complainant and have also gone through the record of the case, carefully.
  6. The ld. counsel for the complainant has argued that the complainant ordered two full sleeve jackets from the website of woodland for the price of Rs.5397/-each and the complainant received the products on 26.12.2020.The ld. counsel further argued that the complainant was not satisfied with the products as it was entirely different from the presented photo on the website. The ld. counsel further argued that the complainant wanted to return the product but the return option was not updated. The ld. counsel further argued that the complainant sent email on 27.12.2020 requesting the OP to update the return option. The ld. counsel further argued that on 28.12.2020 OP asked the complainant to send the product via India Post.The ld. counsel further argued that the complainant sent both the products  via India Post  as per receipt Ex.C10 and requested for the refund of her money back. The ld. counsel further argued that the OP received the products back on 7.1.2021 but there was no intimation regarding the same. The ld. counsel further argued that price of one jacket was received but the price of 2nd product was not refunded. So the complaint be allowed.

To prove her complaint, Gaganpreet Kaur has tendered his affidavit, Ex.C1 and she has deposed as per her complaint, Ex.C2 is the Aadhar card, Ex.C3 is receipt of one jacket of Rs. 5397/-,Ex.C4 is the receipt of 2nd jacket of Rs. 5397/-, Ex.C5 is delivery certificate;Ex.C7 is the email sent by the OP to the complainant wherey she was directed to send the product back through India Post.Ex.C8 is the e-mail of the OP sent to the complainant, Ex.C10 is the receipt of India Post, it is accompanied by e-mail sent by the complainant to the OP whereby she requested that half of the refund amount of Rs. 5397/-was received but the amount of 2nd jacket of Rs. 5397/- was not refunded.
  8. So from the documents, it is proved that two full sleeves jackets were purchased from the OP vide Ex.C3 and Ex.C4 for Rs. 5397/-respectively. As per the complainant the jackets were not the same which were shown on the website and she requested the OP for the return of the same. Vide email Ex.C6 sent by the OP  the complainant  was directed to dispatch the product via India Post at the address mentioned in the email. So both the jackets were returned through India post vide Ex.C10 but the complainant on 31.1.2021 wrote  e-mail to the OP that she has received only half of the amount of Rs.5397/- and has not received the rest of the amount of Rs. 5397/-.
  9. So it is clear that both the jackets were returned to the OP but refund of one jacket was given and refund of 2nd jacket was not made.
  10. So due to our above discussion the complaint is allowed and the OP is directed to refund the amount of Rs. 5397/-to the complainant alongwith interest @6% per annum from 23.12.2020 and also to pay Rs.2000/-as compensation and another amount of Rs.2000/-as costs of litigation expenses.  

Compliance of the order be made by the OP within a period of 45 days from the date of the receipt of the certified copy of this order.
