Final Order / Judgement

Today is fixed for awaiting order of Hon’ble State Commission, West Bengal. Dhr is absent on call and No steps taken on his behalf. Jdr files an Advocate letter of Ld. Advocate Geeta Handa Khanuja of Calcutta High Court stating that an appeal is filed before the Hon’ble State commission bearing No. FA/537/2014. Hon’ble State Commission pleased to pass an order dated 04.05.2017 in connection with First Appeal No. FA/537/2014 arising out of CC Case No. CC/38/2011 of CDRF, Hooghly in which Hon’ble State Commission allowed the appeal filed by the Jdr herein and dismissed the final order passed on 08.04.2014 passed in case no. CC/38/2011 of CDRF, Hooghly.

           Dhr Rehna Yasmin and Quazi Mohammad Monir filed an execution application case being No. 18/2014 under Section 25 & 27 of the C.P. Act, 1986 to execute the order dated 08.04.2014 in connection with CC Case No. 38/2011. Getting notice of Execution Application the Jdr/OP appeared before this Forum on 27.04.2014 and stated that he preferred an appeal before the Hon’ble State Commission, West Bengal challenging the order of CC Case No. 38/2011 of CDRF, Hooghly. It appears from the order passed by Hon’ble State Commission, West Bengal vide order dated 4th May, 2017 dismissed the final order of            CC Case No. 38/2011 dated 08.04.2014. In these circumstances we are in the opinion to drop the execution case being no. 18/2014 as the CC Case being no. 38/2011stands dismissed by the Hon’ble State Commission West Bengal. So, any execution regarding the order of that case finds no merit.

ORDERED

     Hence the execution case being no. 18/2014  in c/w CC 38/2011 be and same is dropped.
