JUDGMENT

 

JUSTICE SRI.K.R.UDAYABHANU  : PRESIDENT

 

            Appellant is the complainant.  The opposite party is under orders to pay a sum of Rs.30000/- to the complainant in CC.378/09 in the file of CDRF, Ernakulam.

          2. The matter relates to non availability of water from the bore well drilled by the opposite party/respondent.  The opposite party stood ex parte in the proceedings before the Forum.  The complainant has sought for compensation of Rs.60,000/-.

          3. The evidence adduced consisted of  Exts.A1 to A5 and A6 series.

          4. The Forum considering the evidence adduced in the  matter  ie, Exts.A1  to A5 and A6 series of documents  ordered a compensation of Rs.30000/-.  On a   perusal of the order of the Forum we find that there is no patent illegality in appreciation of evidence.   Evidently it was not be possible  to  predict the availability of water with cent percentage  of precision .  We find that there is no scope for admitting the appeal.

          In the result appeal is dismissed in limine.

          Office is directed to forward the copy of this order to the Forum urgently.
