The Complainant is present in person.
The case is taken up for hearing on the point of admission.
The Complainant submits that his brother Bhaskar Paul, since deceased purchased one washing machine and there is deficiency in service on the part of the O.Ps. He also submits that the wife of late Bhaskar Paul is still alive.
Perused the complaint and the documents filed by the Complainant.
We have considered the submission of both sides.
One Bhaskar Paul, since deceased, purchased one washing machine and the allegation is against the O.Ps for deficiency in service.
According to the Consumer Protection Act, 1986, Complainant means in case of death of a consumer his/her legal hair or representative.
In the present case, the present Complainant Sekhar Ranjan Paul is not a legal hair/representative of Bhaskar Ranjan Paul. Hence, he is not eligible to file a complaint as Complainant.
Therefore, we have no hesitation to hold that the present case is not maintainable.
Hence, the case be dismissed.
