8)       written statement     Considering the above observations of the Hon’ble Supreme Court and also the observations of the Hon’ble National Commission in the case of Vinaya Vilas Sawant V/s. Union of India, reported in I (2008) CPJ 13 (NC) that the railways are liable to maintain in good order platforms, footpaths, over bridges for ingress and egress of passengers and all other passengers facilities and amenities, thus, in our view the contention raised by the Opposite Parties that they are not liable to pay damages to the Complainant for the incident dtd.03/01/2007 in our view is without any substance.    

O R D E R

i.                   Complaint No.268/2008 is partly allowed against all the Opposite Parties and they are directed to pay Rs.25,000/- (Rs. Twenty Five Thousand Only) in respect of all the claims made in the complaint.

ii.                The Opposite Parties shall comply with the aforesaid order within one month from the date of service of this order. 

iii.              Certified copies of this order be furnished to the parties.
