This order is arising out of the M.A. being No. 166/2017 dated 02.08.2017 filed by the Dhr in the Execution Application No. 123/2015 praying for execution application. The copy is served upon the other side. The Ld. Counsel for the Jdrs is present. But today none is present on behalf of the Dhr. As the complainant got knowledge that today is fixed for hearing on the said M.A but she did not bother to be present today without taking any step, hence we take up the hearing on the said M.A in presence of the Ld. Counsel for the Jdr.

We have carefully perused the contents of the application which has filed by the Dhr. It is seen by us that the prayer is made by the Dhr for restoration of the execution application. It is evident from the record on 16.03.2016 the present execution application was disposed of.

Under this circumstances this Ld. Executing Forum has no authority to review or recall its own order in view of the judgement passed by the Ld. Larger Bench of the Hon’ble Supreme Court in the case of Rajeev Hitendra(supra). Therefore, the application being M.A. No. 166/2017 having no merit is hereby dismissed without any cost.
