Complainant files hazira through his Ld. Advocate.

Today is fixed for admission hearing. Perused the complaint and documents. It appears to us that a prima case has been made out against the OP. Let, the case be admitted.

Complainant is directed to file requisites in the meantime.

Issue summons/notice accordingly.

B.C. to do the needful.

On the date of filing of this case, the complainant files another application U/S 38 of the Consumer Protection Act, 2019 for seeking interim relief is taken up for hearing and treating the same as M.A. Case No. 12/2024.

The petition dated 16/01/2024 filed by the complainant for restoration of his electricity line is taken up for hearing treating the same as M.A. Case No. 12/2024.

Heard Ld. Advocate for the complainant. Considered.

It is the submission of the complainant that the OP issued an electric bill i.e. included the outstanding or challenged bill to the complainant.

Perused the petition. Considered. It is the submission of the complainant and prays for passing an order directing the OP to for restoration of his electricity line being Consumer ID No. 521054085 and replace the defective meter being No. RSX36218 by a new meter.

We think ends of justice would be met up if the OP/WBSEDCL directing to restore electricity connection of the complainant and replace the Meter Vide No. RSX36218 by a new defect free meter and complainant pays the current electric bill month by month/quarterly in respect of this service connection.

In this juncture without going into the merit of the case we think Electricity is most essential part of the human life in present day situation. Moreover, the complainant is depending upon the present electricity connection to run submersible pump situated at his agricultural land i.e. for his livelihood

Hence, we think prayer is to be allowed.

Hence, it is,

                        ORDERED,

                                                the petition dated 16/01/2024 filed by the complainant for restoration of his line i.e. M.A. Case No. 12/2024 is allowed on without contest. No cost.

The complainant is directed to pay the amount of 25% of electricity bill month: December 2022 before the OP office within 4 days from this date of order.

The OP/WBSEDCL is directed to restore electricity connection being Consumer ID No. 521054085 of the complainant within 2 days after receiving the aforesaid amount from the complainant. OP is also directed to issue bill month by month/quarterly without generating the challenged bill or outstanding bill.

The OP/WBSEDCL is also directed to replace the meter being No. RSX36218 by a new defect free meter within 15(Fifteen) days from this date of order.

The complainant is also directed to pay the current bill month by month/quarterly in respect of this service connection.

Thus the M.A. Case No. 12/2024 is disposed of.

Fix.  23/02/2024 for S/R, appearance and W/V from/by OP. Interim order will be effected till the date.

Copy of this order be supplied to the parties each at free of cost.
