ORDER

Shri Sudip Majumder- President-in-Charge.

Complainant files hazira through his Ld. Advocate.

Today is fixed for admission hearing. Perused the complaint and documents. It appears to us that a prima case has been made out against the OP/WBSEDCL. Let, the case be admitted.

Complainant is directed to file requisites at once.

Issue summons/notice accordingly.

B.C. to do the needful.

On the date of filing of this case, the complainant files another application U/S 38 of the Consumer Protection Act, 2019 for seeking interim relief is taken up for hearing and treating the same as M.A. Case No. 21/2023.

Perused the interim application and documents. Heard Ld. Advocate on behalf of complainant.

We find from the interim application and document that the complainant intended to have electric service connection in his premises and as such he submitted an application being No. 50032668235 before OP department.

That after getting application duly filed up along with relevant documents the OP being satisfied that all the formalities have been complied with inspected the spot and sent quotation of Rs. 1590/- vide quotation dated 16/03/2022 to effect the electric service connection in the premises of the complainant (Quotation is annexed as annexure 1).

That the complainant after receiving the quotation deposited the quotation amount of Rs. 1190/- and Rs. 400/- through receipt No. 132504966598 and 127304971794 dt. 11/05/2022 before the OP (The money receipts are annexed as annexure 2a & 2b)

 

 

 

 

That the complainant had not been given electric service in her premises and as such he had been to the office of the OP and requested to effect the electric service connection in his premises, but they refused and the reason of refusal best known to them.

That the comp0lainant had filed an application on 22/05/2023 to have the electric service connection in his premises and complied all the formalities and as such he is entitled to get the service connection separately in his premises u/s 43 of the Electricity Act (The application is annexed as annexure-3).

That the complainant therefore prays:-

  1.  For that the opposite party the ordered an ad-interim directing the opposite party to effect electric service connection in the premises of the complainant and that too ends of justice and for further order as your Honour deem fit and proper.

 

In this juncture without going into the merit of the case we think electricity is most essential part of the human life in present day situation. Moreover, the complainant apply new electricity connection for his domestic purpose.

We think ends of justice would be met up if the OP is directed to supply the new electricity service connection of the complainant.

Hence, it is,

                        ORDERED,

                                                the petition dated 07/07/2023 filed by the complainant for supply the new electricity service connection in the premises of the complainant i.e. M.A. Case No. 21/2023 is allowed without contest. No costs.

The OP/WBSEDCL is directed to supply the new electricity service connection in the premises of complainant being Application No. 50032668235 before OP department within 15(Fifteen) days from this date of order.

Thus the M.A. is disposed of.

Fix.  22/08/2023 for S/R, appearance and W/V from/by the OP/WBSEDCL.

Copy of this order be supplied to the parties each at free of cost.
