Final Order
This complaint is filed by the Complainants u/S 12 of the Consumer Protection Act, 1986 alleging deficiency in service as well as unfair trade practice against the OPs as the OPs did not issue correct energy bill till filing of this complaint.
On 20.04 2018 this complaint was fixed for argument and BNA, if any be filed in the meantime. But on the said none was present on behalf of the Complainant, no step was taken on her behalf. But the Ld. Counsel for the OPs was present, who was also ready for argument. The OPs have filed BNA on 20.09.2018. The record reveals that though 31.05.2017 was fixed for adducing evidence by the Complainant and the OPs, till 13.11.2017 the Complainant did not adduce any evidence on affidavit. The OPs have filed written version along with documents, adduced evidence on affidavit in accordance with law. In the interest of natural justice further time was given to the Complainant for adducing evidence on 08.01.2018. Be it mentioned that neither on 13.11.2017 and on 08.01.2018 the Complainant remained present. As the Complainant did not bother to adduce evidence, chance was given to the OPs for adducing evidence and the OPs have duly complied with the said order on 19.04.2018. Thereafter complaint was fixed for argument and BNA on 20.09.2018. As on 20.09.2018 none was present on behalf of the Complainant, though the OPs were present, and as the evidence of the Complainant is not on record, hence we have no option but to dismiss the complaint. In our view that the Complainant has lost her interest to proceed with this complaint further.

Hence it is ordered that the Consumer Complaint no-786/2016 is hereby dismissed for default. However considering the facts and circumstances there is no order as to cost.
Let plain copy of this order be given to the parties free of cost as per the CPR, 2005.
