ORDER

Shri Sudip Majumder- President-in-charge.

Complainant files hazira along with a petition and stated that last week the OP/WBSEDCL disconnected his electricity connection and further the OP restore his electricity connection. Complainant is present himself.

Today is fixed for filing requisites.

Complainant files requisites today. Issue summon/notice accordingly. B.C. to do the needful.

On the date of filing of this case, the complainant files another application U/S 38 of the Consumer Protection Act, 2019 for seeking interim relief is taken up for hearing and treating the same as M.A. Case No. 36/2023.

Perused the interim application and documents. Heard the complainant.

We find from the interim application and document that the complainant has an electric service connection for his Poultry Firm being Consumer ID No. 501508003 under the OP and the same connection for his livelihood purpose. Complainant has been paying electric bill regularly as per consumption and he was not a defaulter. Complainant paid electric bill dated 25/07/2023 amounting to Rs 3,160/-. The OP is threatening the complainant to disconnect the service connection in their premises if he does not pay the entire outstanding electricity bill lying in the name of Satyajit Ankur, who has another electric connection. The complainant has not nexus with the Satyajit Ankur inspite of that the OP compelled him to sign on a paper in which the officer of them wrote some declaration wherein it was stated that the complainant will try to make arrangement to deposit the arrear electric bill of said Satyajit Ankur otherwise his service connection will be disconnected and he would not protest on that matter.

 

 

At present the complainant is apprehending his electricity connection may be disconnected if he does not meet their illegal demand. Thus the complainant prays for an ad-interim order to restrain the OP to disconnect the service connection.

In this juncture without going into the merit of the case we think electricity is most essential part of the human life in present day situation. Moreover, the said electricity connection is for livelihood purpose.

We think ends of justice would be met up if the OP is directed not to disconnect the service connection of the complainant.

Hence, it is,

                        ORDERED,

                                                the petition dated 23/08/2023 filed by the complainant for not to disconnect his electric connection i.e. M.A. Case No. 36/2023 is allowed without contest. No cost.

The OP is directed not to disconnect the electricity service connection being Consumer ID No. 501508003 of the complainant. The OP is also directed to issue bill month by month/quarterly as per proper meter reading without generating the challenged bill or outstanding bill lying in the name of Satyajit Ankur.

The complainant also directed to pay the current bill month by month/quarterly in respect of this service connection.

Thus the M.A. is disposed of.

Fix.  13/10/2023 for S/R, appearance & W/V and personal appearance by Station Manager, WBSEDCL, Suri West Customer Care Center.

Copy of this order be supplied to the parties each at free of cost.
