Today is fixed for hearing of argument.

Complainant files hazira. O.P.-WBSEDCL has filed a petition for an adjournment to file WNA.

At this stage, Ld. Advocate for the complainant has filed a verified petition praying for disposing of the case for non-prosecution on the grounds that during pendency of the case, the dispute has amicably been settled down out of the Commission and on the basis of compromise, the complainant is not willing to proceed with the case further. Copy served.

Ld. Advocate of the other side raised no objection.

Accordingly, the petition filed by the O.P. has no bearing at all and the same is rejected.

Perused the case record and the petition.  Complainant-Sk. Rajiul Islam  has filed the said petition with verifications. It appears that the dispute of this case has already been settled down amicably in between the parties. The Commission has no other alternative but to dispose of the case.

Hence, it is

ordered

 that this case being No. C.C.No.29/2019 be and same is dismissed for non prosecution but without any cost.

Let a copy of this order be given to the parties on free of cost.
