ORDER

Shri Sudip Majumder- President-in-Charge.

Today is fixed for hearing of the petition dated 12/12/2023 filed by the complainant and W/O if any.  Both parties are present. Complainant is also present himself.

The petition dated 12/12/2023 filed by the complainant for restoration of his electricity line is taken up for hearing treating the same as M.A. Case No. 59/2023.

The OP/WBSEDCL has contested the application without filing any written objection.

Heard both sides. Objection raised by the OP side.

We find that an interim order was passed on 17/02/2023 and the OP was directed to restore the electricity service connection being Consumer ID No. 502275438 of the complainant. But the OP further disconnected the electric service connection of the complainant being ID No. 502275438 electric service connection of the complainant violating the ad-interim order dated 17/02/2023 passed by this District Commission.

It is the submission of the complainant that the OP issued an electric bill i.e. included the outstanding of challenged bill to the complainant.

Perused the petition. Considered. It is the submission of the complainant and prays for passing an order directing the OP to replace the defective meter being No. YX037044 by a new meter. Objection raised by the OP side.

We think ends of justice would be met up if the OP replace the Meter Vide No. YX037044 by a new defect free meter and complainant pays the current electric bill month by month/quarterly in respect of this service connection.

In this juncture without going into the merit of the case we think Electricity is most essential part of the human life in present day situation. Moreover, the complainant is depending upon the present electricity connection to run submersible pump situated at his agricultural land i.e. for his livelihood

Hence, we think prayer is to be allowed.

Hence, it is,

                        ORDERED,

                                                the petition dated 12/12/2023 filed by the complainant for restoration of his line i.e. M.A. Case No. 59/2023 is allowed on contest. No cost.

The OP/WBSEDCL is directed to restore electricity connection being Consumer ID No. 502275438 of the complainant within 7 days from this date of order. OP is also directed to issue bill month by month/quarterly without generating the challenged bill or outstanding bill.

The OP/WBSEDCL is also directed to replace the meter being No. YX037044 by a new defect free meter within 15(Fifteen) days from this date of order.

The complainant is also directed to pay the current bill month by month/quarterly in respect of this service connection.

Thus the M.A. is disposed of.

Fix.  21/02/2024 for filing OPW. Interim order will be effected till the date.

Copy of this order be supplied to the parties each at free of cost.
