Complainant files hazira through his Ld. Advocate. Complainant is also present himself.
Today is fixed for admission hearing. Perused the complaint and documents. It appears to us that a prima case has been made out against the OP/WBSEDCL. Let, the case be admitted.
Complainant is directed to file requisites at once.
Issue summons/notice accordingly.
B.C. to do the needful.
On the date of filing of this case, the complainant files another application U/S 38 of the Consumer Protection Act, 2019 for seeking interim relief is taken up for hearing and treating the same as M.A. Case No. 04/2023.
Perused the interim application and documents. Heard Ld. Advocate on behalf of complainant.
We find from the interim application and document that the complainant has an electric service connection being Consumer ID No. 500662815 under the OP. Complainant submits that he took electric line for his livelihood purpose. Complainant has been paying electric bill regularly except the outstanding bill amount of Rs. 107744/- which is an exorbitant bill being claimed in every month. OP is threatening the complainant to disconnect the service connection in his premises if he does not pay the entire outstanding electricity bill.
The complainant also mentioned that he paid the electricity bill of Rs. 9400/- dated 28/09/2022. At present the complainant is not able to pay the outstanding electricity bill which is exorbitant. Thus the complainant prays for an ad-interim order to restrain the OP to disconnect the service connection.
In this juncture without going into the merit of the case we think electricity is most essential part of the human life in present day situation. Moreover, the complainant is depending upon the present electric line for his livelihood.
We think ends of justice would be met up if the complainant is directed to pay lump sum amount to the OP and the OP is directed not to disconnect the service connection of the complainant.
Hence, it is,
ORDERED,
the petition dated 07/02/2023 filed by the complainant for not to disconnect his electric connection i.e. M.A. Case No. 04/2023 is allowed without contest. No cost.
The complainant is directed to deposit a sum of Rs. 12,000/- (Twelve thousand only) within 15 days from the date of this order in the concerned office of the OP/WBSEDCL.
The OP/WBSEDCL is directed not to disconnect the electricity service connection being Consumer ID No. 500662815 of the complainant. OP is also directed to issue bill month by month/quarterly without generating the challenged bill or outstanding bill.
The complainant also directed to pay the current bill month by month/quarterly in respect of this service connection.
Thus the M.A. is disposed of.
Fix. 23/03/2023 for S/R, appearance and W/V from/by the OP/WBSEDCL.
Copy of this order be supplied to the parties each at free of cost.
