West Bengal State Electricity Distribution Company Limite Mayureswar Customer Care Centre - Opp.Party(s)

ORDER

Shri Sudip Majumder- President-in-charge.

Complainant files hazira through his Ld. Advocate.

Today is fixed for filing amended complaint along with notice upon the op by the complainant.

Issue summons/notice accordingly.

B.C. to do the needful.

The complainant files another application U/S 38 of the Consumer Protection Act, 2019 for seeking interim relief is taken up for hearing and treating the same as M.A. Case No. 66/2023.

Perused the interim application and documents. Heard Ld. Advocate on behalf of complainant.

We find from the interim application and document that the complainant has an electric service connection being Consumer ID No. 522037230  under the OP. Complainant submits that he took electric line for agricultural purpose i.e. for his livelihood purpose. Complainant has been paying electric bill regularly except the outstanding bill amount of Rs. 2,73,094/- dated 20/06/2023 which is an exorbitant bill. OP has already disconnected the electric service connection of the complainant.

At present the complainant is not able to pay the outstanding electricity bill which is exorbitant. Thus the complainant prays for an ad-interim order for restoration of his electric service connection.

In this juncture without going into the merit of the case we think Electricity is most essential part of the human life in present day situation. Moreover, the complainant is depending upon the present electricity connection to run submersible pump situated at his agricultural land i.e. for his livelihood.

We think ends of justice would be met up if the OP is directed to restore the service connection of the complainant.

Hence, we think prayer is to be allowed.

Hence, it is,

                        ORDERED,

the petition dated 28/12/2023 filed by the complainant for restoration of his line i.e. M.A. Case No. 65/2023 is allowed without contest. No cost.

The OP/WBSEDCL is directed to restore electricity connection being Consumer ID No. 522037230 of the complainant within 07 days from this date of order.

OP is also directed to issue bill month by month/quarterly without generating the challenged bill or outstanding bill.

The complainant is also directed to pay the current bill month by month/quarterly in respect of this service connection.

Thus the M.A. is disposed of.

Fix.  29/01/2024 for S/R, appearance and W/V from/ by the OP. Interim order will be effected till the date.

Copy of this order be supplied to the parties each at free of cost.
