Complainant files hazira. The case record is taken up for admission hearing. Perused the case record and the document filed therewith. Heard Ld. Lawyer for the complainant. Considered.

Complainant’s case in brief is that he is a consumer of electricity under the opposite party, WBSEDCL having consumer ID no. 212068143. Complainant received electric bill of his said connection from the opposite party for the month of july, 2010 to September, 2010 and he paid amount of the said bill on 21/10/2010 for which a money receipt being no.036965 was issued to him by the opposite party, other two bills were paid on 20/11/2010 and 11/12/2010 under two separate money receipts. It is stated that when the next bill for the month of October to December 2010 was received by the complainant then it was found that an outstanding amount of Rs.973/- stated to be the period of October 2010 is payable. Seeing that the complainant became surprised and he went to the office of the opposite party and produced the money receipt and enquired as to why the said outstanding amount has been claimed although he paid the said amount under previous bill.  Hence this complaint. It thus appears that the cause of action for such outstanding amount of Rs.973/- has arose in the year 2010 but the present complaint has been filed on

04/05/2016 i.e. long after the period of limitation of two years. We are, therefore, of the view that the present complaint is clearly barred by limitation and as such the petition of complaint is not admitted.
