Today is fixed for Misc. Applications being No. 127 and 128.

The Ld. Advocate of the complainant and the Ld. Advocate of the Ops are present.

One of the application relating to addition of necessary party and another for amendment of the complaint. W/O to both the applications are filed by the Ld. Advocate of the Ops. After hearing the Ld. Advocates on both sides and giving consideration to both Misc. Applications. W/O and other material on record, we find merit in both the applications.

The prayer for amendment and the prayer of addition of party are allowed.

The Ld. Advocate appearing for the complainant is directed to file amended complaint by 21.11.2022.

Another W/O is filed by the Ld. Advocate of the Ops to withstand the prayer for withdrawal of the original documents from the case record. But prayer for withdrawal of the original documents was made by the complainant and that was allowed in the past. The original documents are not lying with the record and therefore the objection raised by the Ld. Advocate of the Ops by filing the said petition cannot be upheld and hence calls for no action.

The Ld. Advocate appearing for the Ops files amended complaint with copy to the other side. Both the aforesaid two miscellaneous applications and another ordinary application filed by the Ld. Advocate of the OP are thus disposed of.

The Ld. Advocate of the complainant is directed to issue notice to the added OP fixing 21.11.2022 for S/R and appearance and asking him/them to file W/V within 30 days from the date of the receipt of the notice.

Let a plain copy be given to the parties free of cost as per CPR.
