This order is arising out of the MA being no-305/2018 filed by the Dhr in the Execution Application no- 142/2015, praying for appointment of an Advocate Commissioner for execution of the sale deed in favour of the Dhr.

The Dhr has prayed for allowing this application otherwise the interest of the Dhr will be seriously prejudiced. Upon perusal of the application we are of the view that admittedly the execution and registration of the Deed of Sale is very much urgent to the Dhr and without same the Dhr is not in a position to enjoy his flat purchased by making payment of his hard earned money.The Dhr has submitted the name of Ms. Madhumita Saha, Ld. Advocate, as an Advocate Commissioner. Ms. Madhumita Saha agreed with this proposal.

Hence Ms. Madhumita Saha, Ld. Advocate is hereby appointed as an Advocate Commissioner for execution and registration of the Sale Deed in favour of the Dhr.

The Dhr is directed to submit the Draft Deed to Ms. Madhumita Saha and along with remuneration to the tune of Rs. 2,500/- for her work and the said amount shall be paid to her prior to starting of her work.

The Dhr shall also incur the conveyance allowance, if any, of the said Ld. Advocate Commissioner. The Dhr is further directed to extend his extreme cooperation to the Ld. Advocate Commissioner so that the Ld. Advocate Commissioner can discharge her duty without any disturbance. The Ld. Advocate commissioner is hereby requested to file the report of registration on the next date along with Dhr i.e. on 04.01.2019.

Let plain copy of this order be given to the parties free of cost as per the provision of the CPR, 2005.
