Attendance through Ld. Advocate is filed on behalf of the complainant.

Admittedly the complainant is a consumer under the O.Ps vide Consumer ID 400653942. It is also undisputed that the complainant defaulted in payment of electricity charges since February, 2020. Xerox copy of bill dated 19.10.2022 was raised to Rs.50,892/- (xerox copy submitted by complainant). Advocate’s notice dated 07.12.2022 depicts excess bill of Rs.42,615/- on 04.08.2021.

Perused the complaint petition and heard submission of Ld. Advocate of both sides as well as materials on record. It shows that the dispute is essentially a billing dispute and in accordance with the provisions of Clause 3.5 of Notification No.55/W.B.E.R.C dated 7^th August, 2013 the District Commission should not have entertained the complaint as there was specific provision to ventilate the grievances before the Regional Grievances Redressal Officer or Central Grievances Redressal Officer or to an Ombudsman, as the case may be.

The complainant without invoking Clause 3.5 mentioned above lodged this case petition for getting redressal, which is premature at this stage.

Hence, it is
