One Renuka Mondal, of Vill. Sindurtopa, P.S. Sainthia, Dist. Birbhum has filed an application U/s 12 of the Consumer Protection Act, 1986 (as amended up to date) against the O.P to cancel the exorbitant e/bill of April, 2019 amount to Rs. 32,782 and that to ends of justice and for other relief. Total valuation is less than Rs. 5 Lacks. Filing of postal order is exempted in view of amended rule 9A of Consumer Protection Rule 1987. The case has been filed in time. Register it. Full requisites have been filed.
The case is taken up for admission hearing as interim petition is filed.

The petitioner also files a petition praying for passing an interim order directing the O.P not to disconnect the electric line being Consumer Id No. 521060255 meter No. SX003995. The petition be treated as M.A/51/2019.
Heard. Perused the petition filed by the Complainant and documents. Heard LD. Advocate/Agent of the Complainant.
We find that the petitioner is the consumer under Ops for enjoying electricity vide Consumer Id No. 521060255, Meter No. SX003995 at Sindurtopa Mouza in her agricultural land as such as the complainant is the consumer under the OP.
That the compliant runs are submersible for better treatment of irrigation and irrigation is the only source of income of the complainant. That she has no other source of income accept the income drive from her agricultural land
That the complainant is consumer the electric connection in her agriculture are land and she has been paying electric bill so far sent by the OP and she not a defaulter in any point of time.
That the OP sent an information with a list of cumulative events and invoice.
That the Complainant sent after receiving the aforesaid bill sent his written representation before the OP on 20/03/2019 with a request to do the needful after proper enquiry but the OP did not take any step to do the needful.
That there after Complainant before the Divisional Manager, WBSEDCL, Bolpur, Birbhum on 28/03/2019 against the said bill for proper adjudication under the Electricity Act. 2003.
That the office of the Divisional Manger receiving the complainant from the complainant on 28/03/2019 but the said complain has not fixed for hearing
That the OP sent the electric bill for the month of April, 2019 with the basis and violating the Law of Electricity enumerated in the Electricity Act, 2003.
That the OP threaten the complainant that according to WBSEDCL regulation in respect of recovery of outstanding dues the service connection vide consumer Id No. 521060255, will be discounted if the outstanding amount not pay.
That the complainant apprehending that if she doesn’t meet illegal demand of the OP the service connection may disconnected and as such it is necessary to cancel the illegal bill for the monthly of April, 2019 issued by A.E. and S.M Ahmadpur, Consumer Care Centre, Ahmadpur, Birbhum and it is the high time to restrain the OP from disconnecting the service connection of the complainant being consumer ID No. 521060255.
That the petitioner requested the Op not to order for disconnection of the valid connection of petitioner for illegal reason, but the Op is denied to listen anything from the petitioner for his wrongful gain and for that petitioner have no other alternative, but to file a suit against the Op for restraining them from disconnection of the electric connection of petitioner.
At this stage without going into merit of case we thing electricity is most essential part of the human life in the present day situation.
So, after hearing the petition and verifying the documents it appears that the Consumer being Id No. 521060255 and her bill amount is Rs. 32,782/- of April 2019 is exorbitant bill and she is paying regular bills and the petition is not liable to pay this amount.
Accordingly the Op is directed not to disconnect the electric line of the Complainant being Id No. 521060255, Meter No. SX003995 and to issue/raise E/Bill after adjusting the reading since the installation of said meter of 3 phases following the rules of WBERC.
The complainant is also directed to pay the current bill month by month/quarterly.
Accordingly prayer for interim order (ad interim) is allowed till 18.06.2019.
Let copy of this order be supplied to the complainant at free of cost.
Let the copy of the order be sent to the OPs by speed post for compliance.
Thus MA is disposed of.
Fix. 18/06/2019 for S/R and appearance.
