ORDER

Shri Sudip Majumder- President-in-Charge.

The Ld. Advocate for the complainant files a petition on stated that the date be fixed today for admission hearing as an urgency. Complainant is also present himself through his Ld. Advocate. Heard, perused the complaint and documents. It appears to us that prima facie a case has been made out against the OP/WBSEDCL.

Let, the case be admitted.

Complainant has already been filed a petition on the date of filing for restoration his electricity connection.

The petition dated 01/03/2024 filed by the complainant for restoration of his electricity line is taken up for hearing treating the same as M.A. Case No. 28/2024.

Heard complainant’s side.

 It appears from the case record that on 20/02/2024 the OP had been to the rented shop room of the complainant in his absence and disconnected the electric connection being Consumer ID No. 501453664 after dismantling the meter from his shop room and also without serving notice U/S 56 of the Electricity Act which is gross violation of law. It also appears from the case record that the complainant has already been paid the last bill i.e. February, 2024 amounting of Rs. 785/- vide Receipt No. 130405489019 dated 09/02/2024.

In this juncture without going into the merit of the case we think Electricity is most essential part of the human life in present day situation. Moreover, the complainant is depending upon the present electricity connection to run his xerox centre situated at his rented shop room i.e. for his livelihood.

 

Hence, we think prayer is to be allowed.

Hence, it is,

                        ORDERED,

                                                the petition dated 01/03/2024 filed by the complainant for restoration of his electricity line i.e. M.A. Case No. 28/2024 is allowed without contest. No cost.

The OP/WBSEDCL is directed to restore electricity connection being Consumer ID No. 501453664 of the complainant within 5 days from this date of order.

OP/WBSEDCL is also directed to issue bill month by month/quarterly.

The complainant is also directed to pay the current bill month by month/quarterly in respect of this service connection.

Thus the M.A. Case No. 28/2024 is disposed of.

Fix.  11/03/2024 for filing requisite upon OP/WBSEDCL. Interim order will be effected till the date.

Copy of this order be supplied to the parties each at free of cost.
