File taken up today on filing of application, by the complainant, for pre-ponement and withdrawal of the case in National Lok Adalat. However, learned counsel for the OP No.1 has suffered a statement, which is recorded separately, to the effect that the matter has been settled between the parties. As per settlement, OP No.1 is ready to replace the AC with new one AC with same model or specification or same specification window AC. It is also settled that OP No.1 is ready to give six month warranty on the New AC within 45 days, subject to returned the old AC with Accessories. Complainant has also suffered a statement that he has heard the abovesaid statement given by the learned counsel for the OP No.1 and agrees with the same and he does not want to pursue the present complaint and withdraws the same.
In view of the statement suffered by the learned counsel for the OP No.1 and the complainant, the present complaint is hereby dismissed as withdrawn. It is made clear that parties shall remain bound by their statements. Certified copy of this order passed in National Lok Adalat be supplied to the parties concerned, free of costs, as per rules. File be indexed and consigned to record room, after due compliance.
