This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite party alleging deficiency in service and unfair trade practice on the part of the opposite party. After admitting the complaint notice was issued to the opposite party. The said notice was accepted by the opposite party on 24/07/2024. After accepting the notice, the opposite party entered appearance and filed written version dyeing the allegation raised by the complainant. Subsequently both parties submitted that there is a chance of settlement and hence the matter was referred for mediation. When the case came up for consideration today, both parties were present and submitted that the matter is settled. The compromise memo signed by both parties is also filed before this Commission. As per the compromise the opposite party has agreed to offer 30% discount for the new Vivo T3 Pro 5G mobile phone proposed to be purchased by the complainant. The complainant has agreed for that offer given by the opposite party and further agreed to purchase the said phone for an amount of Rs.18,900/- (i.e. the amount after 30% discount). Both parties mutually agreed to grant 30 days time for complying this order. The compromise memo singed by both parties is accepted and recorded. In view of the settlement arrived at between the parties to the proceedings, we find that this is fit case to be allowed in terms of compromise.
In the result the complaint is allowed in terms of compromise. The compromise memo dated 02/11/2024 shall form part of this order. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
