1. This complaint is filed under section 35 of Consumer Protection Act 2019 and stood over to this date for consideration and this Commission passed the following order.
2. This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. Notice issued to opposite parties 1 & 3 served on 16/11/2022 and the notice issued to second opposite party returned with endorsement “ addressee closed down ’’, and the case was adjourned to 04/01/2023 for appearance of opposite parties 1 & 3 and for steps against second opposite party. After accepting the notice, the opposite parties 1 & 3 not entered appearance and hence both opposite parties 1 & 3 were called absent and set exparte on 04/01/2023. As the complainant has not taken any steps against second opposite party, a notice was issued to the complainant to appear before this commission to further proceed with this complaint. At present the case is adjourned to 03/07/2023 for appearance of the complainant for taking steps against second opposite party. Meanwhile the complainant filed a memo stating that the dispute between the complainant and the opposite parties were settled out of court and hence he is not willing to further proceed with this complaint. To consider the memo filed by the complainant, this case is suo moto advanced from 03/07/2023 to this date. The memo filed by the complainant is accepted and recorded. In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be dismissed as settled.
In the result, the complaint is dismissed as settled. There will be no order as to costs.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
