Final Order / Judgement

         In Court, copy of certificate dated 18.02.2008, which is available at page No.21 of the appeal, has been handed over by Counsel for the appellant to the respondent/complainant, who is present in Court.

                 Counsel for the appellant, on getting instructions from Sh. Kanwar Lal, Deputy Manager (Legal) of the appellant Bank, states that if the respondent/complainant move an application for refinance of the machine, which is dispute in this complaint, the Bank will not raise any objection and refinance the machine on the basis of bill now handed over to the respondent/complainant, subject to fulfilling other conditions, if any. It is further stated that the appellant/Opposite Party shall pay an amount of Rs.5,000/-, as compensation, Rs.5,000/- as litigation expenses awarded by the Forum and Rs.3,000/- more towards litigation expenses towards the appeal to the respondent/complainant, within two weeks from today.

                 Office is directed to release the amount, which was lying deposited by the appellant, at the time of filing the appeal, to the appellant alongwith interest, if any, which may have accrued on the Fixed Deposit Receipt within 7 days from today.

                 In view of the consent of both the parties, this appeal stands disposed of.

                 Certified copies of this order be sent to the parties, free of charge.
