This is a complaint file by the above said complainant U/s.12 of the C.P.Act., 1986, against the O.Ps alleging deficiency in service. The gist of the case is as under:

The complainant avers that, the Vishwa Pattina Souharda Sahakari (N) Society is registered under the provisions of Karnataka Societies registration Act, vide Registration No. 951/02-03 dated 16/05/2002. The O.P.No.1 is the registered Society, O.P.no. 2 is the President/Managing Director, the O.P.No.3 and 4 are the Managers and rest of O.P.No. 5 to 11 are the Directors of the said Society. The complainant claims that, he having retired from his service on superannuation from the Judicial department, out of the service benefits received consequent upon the retirement, got deposited the following amounts in fixed deposits with the O.Ps Society.

3. Further the complainant states that, the fixed deposits matured on 12/08/2014 and 06/04/2014 respectively. On the request of the complainant the O.Ps have not released or paid the amount of fixed deposit along with their maturity value to the complainant and delayed the matter for one or other reasons. In spite of receipt of legal notice the O.Ps have failed to release the F.D. amount in favour of the complainant. Due to non release of F.D. amount, the complainant suffered loss and also underwent mental agonies. Hence the complainant filed the complaint before the Forum.
4. On the service of the Court’s notices the O.P.no. 1,2 & O.P.no.4 to O.P.no. 11 have not appeared before this Forum, hence except O.P.no.3 all the O.Ps have been placed exparte. The O.P.No.3 has filed his written version therein stated that, the complaint is misconceived both in law and facts and it is not maintainable. The O.P.No.3 has not dispute of the content of para 1 of the complaint regarding the respondent society is a registered society and got registered under the provisions of Karnataka Sourharda Sahakari Act. The O.P.no.1 is the president/Managing Director of the society and present O.P.no.3 is the present CEO and O.P.no.4 is the previous CEO of the O.P. Society and having other Directors of the society and running the financial business. Further the allegation made in para no.2 are false that at the instance of respondent society by it’s CEO- respondent no.3 and respondent no.1 President, the complainant made fixed deposit the amount, hence the complainant be put to strict proof of the same due to the present O.P. joined as CEO of the respondent society in the month of December-2015 only, so the respondent no.3 has no knowledge regarding transaction of the complainant with society in respects of FDR hence it is denied in to to.

Reply to the para no.3 of the complaint, the O.P. no.3 denies the contention of the complainant that, the period of said fixed deposits have already been matured long ago with their maturity value and further the complainant never approached the O.Ps and not furnished the fixed deposit receipts and further the allegation made by the complainant that all times the O.Ps have delayed the matter for one or the other reasons is absolutely wrong, hence the complainant cannot allege the deficiency in service of the O.Ps. The O.P.no.3 denied the contents of para no.4 and 5 of the complaint regarding repayment of amount and transaction not concerned to the O.P.no.3 and the same is subject to strict proof. The other oral allegations made against the O.Ps are totally false, and there is no negligence or deficiency in services from the O.Ps. and there is no cause of action arisen in this case and there is no jurisdiction to this Forum in respect of disputes arise regarding Co-operative societies act hence the complaint may be dismissed with costs.
6. Considering the rival contentions of the parties, the following points arise for our consideration:-

8. The O.P.No.1 herein is a juristic person, represented by its’ Managing Director. O.P.No.2. directors O.P.No.4 to O.P.No.11 and also O.P.No.3, Manager. Excepting O.P.NO.3, none else has put up appearance and have been placed exparte.

The O.P.No.3, claiming himself as the present Chief Executive Officer of O.P.No.1 is feigning ignorance about the Fixed Deposits even after availing scopes to see the documents produced as Ex.P1 to P3. His alleged ignorance is based on an averment that, he joined the establishment of O.P.No.1 only during 2015. We find no merit in the evasive denial of theO.P.No.3, since after assuming charge, all the records of the society were accessible to him and hence cannot be permitted to take shelter of the fact of later joining.
10. The O.P.No.3 has further raised a misconceived point that, the matter being of a co-operative society, this Forum lacks jurisdiction to try this complaint. Albeit, Section 125 of the Co-Operative Societies Act holds a stipulation of obtaining prior permission of the Registrar, the issue in hand is not between the member and management of the society. It is a matter of Banking simplicitor and thereby is well within the ambits of this forum in terms of section 2(1)(0) of the C.P.Act,1986.
11. The O.P. has not made the payments even after the F.D.s were matured (Ex.P1 to Ex.P3) inspite of receiving legal notice Ex.P4. Surprisingly, coming across the F.D. receipts in the case file, no remorse has been expressed and no assurance was ever extended to enquire the matter to settle the claim of the complainant. Hence we hold that, there is clear cut deficiency of service and we answer point No.1 in affirmative.
12. Point No.2. It appears, the complainant is not very sure about his claims. In para-2 he is claiming the proceeds of three F.D.s but in the prayer column the third deposit is struck off. So also in evidence affidavit and written arguments he canvasses only about two deposits in Account No.890/11 and Account No.982/12 (Ex.P1 and 2). Hence we have to confine our consideration only for the two items stated supra. The two F.D.s have matured on 06/04/2014 and 12/08/2014 respectively and the deposit acceptor society is liable to pay the proceeds of the same and hence we proceed to pass the following:
