                                            ORDER 

            The instant appeal has been filed by the appellant M/s Rohan Motors Limited against the impugned judgment and order dated 26-10-2021 passed by the learned District Consumer Commission, Gautam Buddh Nagar in Complaint Case No. 329/2015 which according to the appellant is an exparte order.

            Learned Counsel for the appellant Sri Nishant Shukla submits that no notice has been served upon the appellant, nor any opportunity of hearing was provided before passing ithe impugned order by the learned District Consumer Commission.

            Without going into the merit of the case, in the interest of justice, this Court deem it appropriate to quash the exparte impugned order dated 26-10-2021 passed by District Consumer Commission with a request to the learned District Consumer Commission to decide the Complaint Case No. 329/2015 after providing due opportunity to the parties within a period of six months from the date of this judgment. The copy of this judgment will be presented by the appellant before the District Consumer Commission, Gautam Budh Nagar within two weeks from today. It is made clear that no unnecessary adjournment will be allowed by the learned District Consumer Commission.

            With the above observation the appeal is disposed of.

Let copy of this order be made available to the parties as per rules.
