            At the time of arguments, a consensus has arrived at between the parties.

2.         Order dated 30.04.2015, under challenge, passed in this case is an exparte order, against which, this appeal has been filed.

3.         Sh. Vinish Singla, Advocate, Counsel for the respondents very fairly stated that let order under challenge be set aside and the matter be remitted to the Forum and opportunity be granted to the appellants to file reply on merits. It is stated that directions be issued to the Forum to decide the matter expeditiously. We appreciate the stand taken by the Counsel for the respondents.

4.         Accordingly, we allow the appeal. The order dated 30.04.2015 under challenge is set aside. Consumer Complaint bearing No.586 of 2014 is remitted to the concerned Forum to decide it afresh on merits.

5.         Order passed is subject to payment of cost of Rs.25,000/- to be paid by the appellants/Opposite Parties. The cost amount be paid to the Counsel  opposite on the next date of hearing before the Forum.  

6.         Parties are directed to put in appearance before the concerned Forum on 11.04.2016. 

7.         The appellants/Opposite Parties shall file their reply and evidence on or before 11.04.2016 positively. No further opportunity shall be granted for the said purpose. It is expected that the Forum will make an attempt to decide the matter preferably within four weeks from the date the parties put in appearance before it, may be by giving shorter dates.

8.         The amount of Rs.3,00,838/- deposited by the appellants while filing the appeal, in this Commission, will not be released in favour of either of the parties till after 30 days of the disposal of complaint by the Forum. The amount deposited be converted into Fixed Deposit Receipt (FDR) initially for a period of six months.

9.         Certified copies of this order be sent to the parties, free of charge.

10.        Complete record alongwith a certified copy of this order be sent to the Forum, immediately, so as to reach there before the date fixed.

11.        File be consigned to the Record Room after completion.
