1. Manpreet Singh @ Happy, complainant has preferred the present complaint against the opposite party (referred to as OP in short) on the ground that on 25.04.2018 he purchased Toothbrush, Toothpaste and disposal briefs from the OP vide retail invoice dated 25.04.2018 for an amount of Rs.609/-. When the complainant checked the bill he found that OP charged an amount of Rs.79/- for toothbrush whereas M.R.P on the article was Rs.75/- . The complainant immediately approached the OP and requested to refund the excess price charged by him but the OP refused to accede the request of the complainant. As such the OP charged Rs.4/- extra from the complainant on one article. Thus, alleging deficiency in service on the part of OP, the complainant has sought following reliefs:-
i) OP be directed to refund the excess amount of Rs.4/- charged by him,
ii) OP be directed to pay to the complainant a sum of Rs.90,000/- on account mental agony and harassment,
iii) OP be directed to pay Rs.5500/- as litigation expenses.
2. None has appeared for OP despite service and as such OP is proceeded exparte.
3. The complainant has tendered documents Ex.C-1 to Ex.C-3 and closed evidence.
4. The complainant's grievance in the present case is that the OP has charged Rs.4/- in excess at the time when he purchased some household goods from the OP on 25.04.2018.

The complainant has stated that on 25.04.2018 he purchased some household goods from the OP for an amount of Rs.609/- vide retail invoice dated 25.04.2018 which is Ex.C-2 on record out of which he purchased a toothbrush for an amount of Rs.79/- but the M.R.P on the article was printed as Rs.75/-, as such the OP has charged Rs.4/- in excess. We have perused the retail invoice Ex.C-2 which has been produced by the complainant on record and find that it has been specifically mentioned in it that cost of the toothbrush was 79/- and below it a less of Rs.4/- has been given to the complainant which means that an amount of Rs.75/- has been charged by the OP only for the toothbrush. The complainant has also stated that actual cost of the toothbrush is Rs.75/- only. As such , we feel that the OP has not charged any excess amount of Rs.4/-.
6. For the reasons recorded above, we find that there is no deficiency in service on the part of the OP and as such the present complaint is dismissed. A copy of the order be supplied to the parties free of charge. File be consigned to records in due course.
